Vylos Terms of Service

These Terms are an agreement between you and Vylos Solutions, Inc. ("Vylos", "we", "us") about your use of the Vylos app for iPhone (the "App") and our website, myvylos.com. Please read them with our Privacy Policy, which explains how we handle your information.

1. Agreeing to these Terms

You accept these Terms when you create a Vylos account or use the App. If you don't agree, don't create an account or use the App.

2. Who can use Vylos

  • You must be 18 or older. When you create an account, you confirm that you are. If we learn that an account belongs to someone under 18, we'll delete it.
  • Vylos is available only on the United States App Store and is meant for use in the United States.
  • One account per person. Give accurate information when you sign up, and keep your sign-in details to yourself. You're responsible for what happens under your account.

3. What Vylos is, and what it isn't

Vylos is a motivational app for adults who already use a continuous glucose monitor (CGM). It reads glucose readings that your CGM has already saved to Apple Health and turns them into a daily Vybe Score, a History, and game features such as Points, streaks and achievements. It's meant to make your CGM data more engaging to look at.

Vylos is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition. It doesn't give medical advice, and it doesn't recommend insulin doses, food, exercise or changes to your treatment. Don't use Vylos to make treatment decisions. Talk to your healthcare provider about your care.

Vylos isn't a glucose monitor, and it doesn't give real-time readings or alerts. Readings can reach Apple Health hours after your CGM records them. Keep using your CGM's own app and alerts, and follow your treatment plan.

4. Apple Health and your CGM

With your permission, the App reads blood glucose readings from Apple Health. It never writes to Apple Health. Vylos doesn't connect to any CGM maker, and isn't affiliated with, endorsed by or sponsored by Dexcom or any other CGM maker. Your CGM and its app are covered by their maker's terms. You can stop the App reading Apple Health at any time (see the Privacy Policy).

5. Your History and progress live on your phone

Your History, Vybe Scores, Points, level, streak and achievements are worked out and stored on your phone. We don't keep a copy, unless you're a tester who chose to share daily results. If you back up your iPhone, the backup may include them (see section 2 of the Privacy Policy). That means:

  • If you delete the App, delete your account, or lose or reset your phone, they're gone from that phone, and we can't restore them. Restoring an iPhone backup that includes them may bring them back, but don't rely on that.
  • On a new iPhone, unless you restore a backup that includes them, Vylos rebuilds your History from the readings still in Apple Health, going back up to 90 days. Anything older isn't rebuilt.

6. Signing out and deleting your account

Signing out. Your History and progress stay on the phone, tied to your account. Sign back in with the same account and they're there. Anyone else who signs in on that phone can't see them.

Deleting your account. To delete your account, email privacy@myvylos.com from the address your account uses. We'll delete it from our servers within 30 days. To remove Vylos data from your phone, delete the App.

7. Vylos Points

Points are a way of tracking your progress in the App. Points:

  • have no cash value, and aren't money, property or a currency
  • can't be redeemed, exchanged, sold, transferred or cashed out. There's nothing to redeem them for.
  • are stored on your phone, so they're lost whenever your phone's Vylos data is lost (section 5)

We may change how Points are earned.

If we ever offer a way to use Points, it'll come with its own terms, and it may not apply to every Point.

8. Using Vylos fairly

Don't:

  • use the App for anything unlawful
  • impersonate anyone, or choose a username that's offensive or pretends to be someone else
  • interfere with or disrupt the App or our servers, or try to get into accounts or systems that aren't yours
  • access our servers by automated means, or copy, reverse engineer, decompile or disassemble the App, except where the law allows it
  • manipulate the App or its Points by technical means

9. Your licence to use the App

Your licence to use the App comes from Apple's Licensed Application End User License Agreement (the Standard EULA). These Terms add to it. Where they conflict, these Terms apply to the extent the Standard EULA allows.

10. Apple

  • These Terms are between you and Vylos, not Apple. Vylos, not Apple, is responsible for the App and its content.
  • Your licence lets you use the App on Apple-branded products you own or control, as the App Store's Usage Rules allow. It can't be transferred.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the purchase price, if any. The App is free. To the extent the law allows, Apple has no other warranty obligation for the App.
  • Vylos, not Apple, is responsible for handling any claims about the App, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and consumer protection, privacy or similar claims, including claims about its use of HealthKit.
  • If anyone claims that the App or your use of it infringes their intellectual property, Vylos, not Apple, is responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you're not in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you're not on any US government list of prohibited or restricted parties.
  • You must follow any third-party terms that apply when you use the App, such as your wireless carrier's.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple can enforce them against you.
  • Questions, complaints or claims about the App go to Vylos at support@myvylos.com.

11. Our rights

The App, the website, and the Vylos name and logo belong to Vylos Solutions, Inc. If you send us ideas or feedback, we can use them without paying you or owing you anything.

12. Changes to Vylos, and test versions

We may change, pause or stop features, or the App itself. Test versions (for example through TestFlight) may be unfinished, may not work as expected, and may lose data.

13. Ending your use of Vylos

You can stop using Vylos and delete your account at any time (section 6). We may suspend or end your account if you break these Terms, if the law requires it, or if we stop offering Vylos. If we end your account, you won't be able to sign in. What's stored on your phone stays there until you delete the App. Sections 3, 7, 11 and 14 to 18 keep applying after your account ends.

14. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, express or implied, to the extent the law allows. We don't promise that the App will be uninterrupted, error-free or secure, that scores or figures will be accurate or complete, or that using the App will lead to any health outcome.

15. Limitation of liability

To the extent the law allows, Vylos isn't liable for indirect, incidental or consequential damages. Nothing here limits liability the law doesn't allow us to limit.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.

17. Changes to these Terms

If we change these Terms, we'll post the new version and update the effective date. If a change is significant, we'll tell you by email or in the App before it takes effect.

18. General

These Terms and the Privacy Policy are the whole agreement between you and Vylos about the App. If part of these Terms can't be enforced, the rest still applies. If we don't enforce a right, we haven't given it up. You can't transfer these Terms to anyone else. We can transfer them as part of a merger, acquisition or sale of our assets.
